What is left

Open question for the editor: the order quotes DOJ (2018 speech) that the Department "intervenes in only about 1 in 5 cases that are filed" (p. 5). No indicator exists for an intervention rate and recording it as a percentage would mean converting the ratio. Propose an intervention-rate indicator or confirm it stays out.

What the document holds

District court order (M.D. Fla., Judge Mizelle, 30 Sep 2024, 53 pp.) in U.S. ex rel. Zafirov v. Florida Medical Associates: background on the FCA and qui tam (relator share up to 30%, 15-25%; treble damages and per-claim fines up to almost $28,000), history of qui tam use (3 actions 1943-1986; about 6 a year before 1986; 31 in FY1987 vs 712 in FY2023; 500 non-qui tam matters FY2023; qui tam recoveries over $2.3 billion FY2023 vs roughly $2.3 million in 1988, relayed from DOJ statistics), DOJ intervenes "in only about 1 in 5 cases", facts of Zafirov's case, and the Appointments Clause analysis holding qui tam relators unconstitutionally appointed; case dismissed. Already in the data: event for the ruling. Added: 7 observations, 3 rules, 1 case row.
