What the document holds

Text of the New York False Claims Act, State Finance Law Art. 13, §§ 187-194, with amendments through 2018 (10 pp.): definitions, liability (civil penalty of $6,000-$12,000 per claim, adjusted to the federal level, plus treble damages; double damages for self-reporting within 30 days), the tax-law conditions (defendant net income or sales of at least $1 million and damages pleaded over $350,000), civil enforcement and qui tam actions (complaint under seal for at least 60 days, state may supersede or intervene within 60 days), parties' rights, relator awards (15-25% if the state intervenes or converts, 25-30% if not, at most 10% if based mainly on public disclosures; reduction for planners, none if convicted), public-disclosure bar, the annual MFCU recovery report (§ 190-b, due 15 April), anti-retaliation remedies (two times back pay), 10-year limitation period. No statistics. The five relator-share rules were already recorded; added the two tax-law thresholds. Not recorded because the data model has no rule type for them: penalty per claim, seal period, intervention window, limitation period, retaliation remedies. Rules restated from other sources are now recorded from this document too (decision 8).
